Perjury
Perjury is the willful act of swearing a false oath or of falsifying an affirmation to tell the truth, whether spoken or in writing, concerning matters material to an official proceeding. Perjury is a felony and provides a prison sentence, fines and other consequences.
To prove a charge of perjury, it must be established that the defendant has lied or omitted facts under oath or otherwise when sworn to tell the truth. This can occur while testifying under oath or while providing information in legal documents such as a tax return.
It may be a viable defense that you were mistaken, or that the false information was given unknowingly or unintentionally or perhaps a question addressed to you in court was misunderstood by you. The prosecution needs to prove that the accused knowingly and willingly lied or omitted information while under oath.
